Daniel Batterman is a highly regarded technology lawyer with almost three decades of experience. He is a Boston-based attorney who provides practical and cost-effective legal counsel on intellectual property, technology, internet, and contract law. He earned a Boston Magazine ranking as one of Boston's top intellectual property lawyers in 2022.

Mr. Batterman represents a wide range of clients including entrepreneurs, start-ups, professional service companies, software developers, SAAS providers, manufacturers, e-commerce companies, retailers, publishers, entertainers, state agencies, non-profits, and many others.

Mr. Batterman, sought after for his ability to protect a company's trademarks, copyrights, and trade secrets, regularly advises clients on licenses, terms of service, contracts, software & IT development, privacy, and defamation matters. He also evaluates and analyzes novel and challenging technology law issues that impact his clients to be prepared in advising them.

In addition, his practice includes substantial litigation experience. Mr. Batterman has been involved in numerous technology, intellectual property, contract, and business disputes. He practices in the trial and appellate courts in Massachusetts, as well as in Federal District Court and First Circuit Court of Appeals.

Experience

Prior to joining the firm, Mr. Batterman served as of-counsel to a downtown Boston firm with the intellectual property, corporate transactions, and litigation practice groups while running his own firm focused on the technology and internet sector.

He gives seminars to students, professionals, and fellow attorneys on intellectual property, trademarks, IT development, licensing, software, privacy, open source, and contracts. Mr. Batterman also served as a guest lecturer at the prestigious Wharton School in Philadelphia, where he lectured graduate and undergraduate students in technology and contract law and advised them on technology-related ventures.

Additionally, he has authored numerous articles and posts on technology law, intellectual property, litigation, contracts, and other legal subjects over the past three decades.

Since 2008, Mr. Batterman has been an organizer and group leader of the Boston Gay Professionals, one of the largest LGBT networking groups in New England (5,000 members and growing).

  • Represented a software developer of advanced EEG software in numerous trademark prosecutions, contract negotiations, open source license analyses, software development agreements, and other commercial transactions.
  • Represented a large Massachusetts state agency and advised and drafted complex online terms of service contracts and privacy policies for its various websites.
  • Represented a large Massachusetts arts & humanities non-profit and drafted complex online terms of service contracts and licenses for its website.
  • Represented a software developer of photographic and augmented reality animation effects in a complex technology licensing and software development contract.
  • Represented and advised a technology automotive services start-up in intellectual property matters and drafted terms of service contracts and privacy policies.
  • Represented an IT services & network engineering company in a partnership dispute and drafted numerous IT development, non-competition/non-solicitation, confidentiality, and other contracts.

  • Represented numerous companies, start-ups, and individuals prosecuting and obtaining trademarks at the United States Patent and Trademark Office.

Dispute Resolution

  • Represented an IT & software developer of custom diagnostic software against a large Massachusetts bio-tech in a development contract dispute.
  • Represented an aviation charter company in a copyright infringement dispute brought by a commercial photographer.
  • Represented a nationally known comedian in a trademark infringement case over use of his name by a foreign comedian in the United States.
  • Represented a woman in a privacy, wiretap, and harassment case against a large Boston radio station after she was illegally recorded by a well-known disc jockey at her place of employment.
  • Represented a well-known Massachusetts printer & publisher in a trademark infringement case over use of its name by a competitor.
  • Represented a corporate high-tech training consultant in a dispute involving the use of copyrighted training and seminar materials.
  • Represented an architecture firm in a copyright dispute with another firm over the design and development of a new building and its cosmetic and architectural features.
  • Represented a mental health professional in a defamation case against a well-known internet troll and harasser.
  • Represented a designer of computerized and digital video baseball training equipment in a non-competition, confidentiality, and theft of trade secrets case by a former consultant.
  • Represented a solar energy company against a well-known corporate trademark bully and troll in a multi-state trademark infringement action.
  • Represented a website developer in a class-action dispute with a competing developer over the sale of domain names.
  • Represented and defended several companies and individuals against a well-known national copyright troll for supposed copyright infringement of various news organizations' images and photographs.
  • Represented a national franchise in a trade secret misappropriation, breach of contract, and breach of fiduciary duty case involving former franchisees and employees.
  • Represented a Massachusetts attorney in a defamation action involving disparaging and false reviews posted on internet review sites.
