Privacy Policy

This policy is intended to help you understand how Lipresti Law, P.C. ("LLPC") collects, uses, and safeguards the information that users ("Users") provide on or transmit through LLPC's website (the "Site") and otherwise in connection with LLPC's services.

What LLPC Collects

Anonymous data. LLPC collects anonymous data, including Internet addresses, dates and times of visits, and pages viewed. LLPC uses this information to monitor and improve the performance of the Site.

Personal information. LLPC collects personally identifiable information (personal information) from Users in a variety of ways, including when Users provide personal information by using the contact forms and email addresses on this Site. If a User accepts the opportunity to be contacted by LLPC - by personal email, telephone, mail, text message or email newsletter - then, as a User, you can revoke that acceptance at any time by contacting LLPC at the points specified below. Users can choose not to provide personal information to LLPC; however, if a User does not provide necessary information, or if a User deletes or removes it, LLPC may not be able to perform certain services for such User (and in some cases may be unable to perform services at all).

Types of non-public personal information LLPC may collect on or through the Site include, without limitation:

  • name, postal address, email address, and telephone number;
  • information received on applications, forms, and in other communications to LLPC, whether in writing, in person, by telephone, or by any other means (including, without limitation, via metadata);
  • information about User interactions and transactions with LLPC or others; and
  • information from User interactions and transactions with LLPC.

Profile. LLPC may store information it collects through cookies, log files, and/or clear gifs to create a profile that details viewing preferences. Consequently, collected information is tied to the User's personal information and may be used to provide offers, improve the content of the site, and for other internal business purposes. Users may choose to set their web browser to refuse cookies or to alert them when cookies are being sent. If a User rejects cookies, such User may still use the Site, but please note that some parts of the Site may be limited or not function properly. LLPC does not share profiles with third parties except as set forth in this Privacy Policy.

Use of Personal Information

LLPC collects and uses personal and non-personal information through the site for the following purposes:

To run, operate, and market our site and services. LLPC uses User information and shares it with select third parties in order to display content on the Site correctly and to otherwise make the Site function properly. LLPC also uses User information and shares it with select third parties in order to maintain, develop, and market the Site and in connection with other services LLPC provides.

To research the Site and services. LLPC may use information in the aggregate to understand how our Users as a group use the services and resources provided on our Site and to evaluate the effectiveness of the Site and LLPC's marketing and business efforts.

To improve the Site and services. LLPC uses User information and feedback and share it with select third parties to improve the Site and services.

To send Users information about topics LLPC thinks will be of interest to them. LLPC uses User information and shares it with select third parties on an ongoing basis to share alerts, details, news, and marketing information about LLPC's services.

To send periodic emails. LLPC may use User email addresses to send Users information and updates or to respond to User's inquiries, questions, and/or other requests.

Sharing of Personal Information

LLPC uses third-party service providers to help operate its business and the Site or administer activities on its behalf. LLPC may share User personal information with these third parties for those limited purposes. LLPC also may disclose any collected information, including User personal information, if it has a good-faith belief that: (1) the disclosure is necessary or useful to LLPC's provision of services; (2) the disclosure is necessary to protect LLPC's rights, interests, or property; (3) the disclosure is necessary or useful to protect User safety or the safety of others, to investigate fraud, or to respond to a government request; (4) the disclosure is required by law, such as to comply with a subpoena, search warrant, court order, or similar legal or administrative process; and (5) LLPC has a transfer of ownership or otherwise are acquired, in which case User information will likely be among the assets transferred. LLPC does not rent, lease, or sell personal information or aggregated non-personally identifiable information collected through the Site.

Choice/Opt-out

Users are given the opportunity to opt-out of having their information used for marketing and information communications. Users can change or update their contact preferences at any time by writing to the contact points below. Users can also opt-out of certain communications with LLPC entirely.

Depending on jurisdiction, Users may have additional rights to access and control their personal information. If a User believes that the Site contains information about such User that needs to be updated, changed, or corrected, or if a User wishes to opt-out of or otherwise control any specific use of his, her or their information, please submit a request to the contact points below. In accordance with applicable law, LLPC will comply with an individual's requests regarding (i) access, change, correction, deletion, or transfer of any such individual's personal information LLPC stores; and (ii) opt-outs or other requests changing or limiting the use or disclosure of any such individual's personal information LLPC stores, including the sharing or sale of such information.

Other Information

Children's Privacy
LLPC believes protecting the privacy of children is extremely important. This Site is not designed to attract individuals under the age of 18. In accordance with the Children's Online Privacy Protection Act, LLPC does not collect or store any personal information, even in aggregate, about children under the age of 13. If LLPC discovers it has received any information from a child under the age of 13 in violation of this policy, it will delete that information immediately. If a User believes LLPC has any information from or about anyone under the age of 13, please contact LLPC at the contact points below.

Linked Sites
This Site may contain links to other websites. LLPC assumes no responsibility for the content or practices of linked websites and such linking should not suggest nor imply any affiliation or endorsement by LLPC of the linked website. LLPC encourages Users to be aware when they leave the Site and to read the privacy statements of every website that collects personally identifiable information. This privacy statement applies solely to information collected through this Site.

Security
LLPC follows industry standards and practices to safeguard all of the information collected through the Site, both anonymous and personal; however, LLPC cannot guarantee the security of User information. While LLPC uses commercially reasonable efforts to safeguard the confidentiality of User information, it hereby disclaims and Users hereby release and hold LLPC harmless for all liability for disclosure of any information obtained on or through the Site. Storage
LLPC reserves the right to store User information for the amount of time LLPC reasonably determines to be necessary in order to perform the purposes for which that information was collected or otherwise processed.

User California Privacy Rights
Under the California Consumer Privacy Act ("CCPA") signed into law June 28, 2018, and entering into effect Jan. 1, 2020, California residents have certain rights and privileges. California Users can exercise any of the following rights by notifying LLPC as described below:

Disclosure Request.
Upon request and when possible, LLPC will disclose the categories and specific pieces of personal information it has collected about Users. Additionally, Users may also obtain the categories of information about Users that LLPC has sold, the categories of third parties to whom the information was sold, and the categories of personal information that LLPC disclosed about Users for a business purpose. Users may submit these requests; by emailing Privacy@liprestilaw.com. When such a request cannot be honored, LLPC will advise a User accordingly.

Deletion.
If a User should wish to cease use of the Site and have his, her or their personal data deleted from the Site, then a User may submit a request by emailing Privacy@liprestilaw.com. Upon receipt of a verifiable request for deletion, LLPC will confirm receipt and will confirm once the User's personal data has been deleted.

Right to Sue for Security Breaches.
Users also have the right to sue in the event User nonencrypted or nonredacted personal information, is subject to an unauthorized access and exfiltration, theft, or disclosure as a result of the violation of the duty to implement and maintain reasonable security procedures and practices. Prior to exercising this right, Users must provide LLPC with 30 days written notice by emailing us at Privacy@liprestilaw.com and providing LLPC with an opportunity to fix this violation.

Under California's "Shine the Light" law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information LLPC shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2022 will receive information regarding 2021 sharing activities).

To obtain this information in connection with information collected through the Site, please send an email message to Privacy@liprestilaw.com with "Request for California Privacy Information" in the subject line and in the body of the message. LLPC will provide the requested information to a User at their e-mail address in response.

California Do Not Track Disclosures

LLPC does not collect personal information about Users' online activities over time and across third-party websites or online services. For this reason, at this time, the Site does not respond to "do not track" signals. Third parties may collect personally identifiable information through the Site as described in this Privacy Policy.

International Transfer

Your information, including personal information, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If a User is located outside the United States and chooses to provide information to LLPC, please note LLPC transfers User information, including personal information, to the United States and process it there. User submission of information to LLPC represents User consent to that transfer. Please note the European Union ("EU") has not adopted an adequate decision with respect to data transfers to the United States; however, LLPC values User privacy and protects User data using reasonable information security practices.

EU Data

Individuals in the EU may have certain rights with respect to their personal information, including the rights to:

  • request access to and rectification or erasure of User personal information;
  • request information about LLPC processing, including categories of User personal information collected, information about the source of that collection, the purposes of collection, the recipients or categories of recipient to whom User personal information has been or will be disclosed;
  • restrict or object to how LLPC processes User personal information;
  • withdraw User consent for LLPC to process User personal information in some circumstances;
  • lodge a complaint with a supervisory authority; and
  • receive User personal information provided to LLPC or have that personal information transmitted to another controller without hindrance (also known as data portability).

LLPC reserves the right to ask for information verifying User identity prior to disclosing any information to a User. Should LLPC ask for verification, the information a User provides to verify its identity will be used only for that purpose, and all copies of this information in LLPC's possession will be destroyed when the process is complete.

Revisions To This Policy

LLPC reserves the right to periodically revise this Privacy Policy. Please check this page periodically for changes. The document revision date displayed below will indicate when this Privacy Policy was last revised. If LLPC decides to change its Privacy Policy, it will post those changes to this privacy statement, and other places it deems appropriate, so Users are always aware of what information LLPC collects, how it is used, and under what circumstances, if any, LLPC discloses it. LLPC will use information in accordance with the Privacy Policy version under which the information was collected.
